The Notary Public serves as an impartial witness to the signing of documents, attests to the signature on the document, and may also administer oaths and affirmations. The State Treasurer appoints a notary public for a five-year period and may renew the appointment for five-year increments. Candidates, who must be New Jersey residents at least 18 years of age, are sworn into office by the Clerk of the county in which the candidate resides.
A notary public who is not licensed as an attorney-at-law shall not use or advertise the title of lawyer or attorney-at-law. A notary who advertises his services must provide a statement “I am not an attorney licensed to practice law and may not give legal advice about immigration or any other legal matter or accept fees for legal advice.”

Document Notarization and Certifications of Notary Public
The County Clerk’s Office can notarize documents for a fee of $2.50 per notarization. Proper photo identification is required. All documents to be notarized must be signed in the presence of the notary.
To prevent any conflicts of interest, the Middlesex County Clerk’s Office cannot notarize any documents that will be recorded or filed in the Middlesex County Clerk’s Office (deeds, mortgages, election petitions, business trade names, etc.).
The Office of the County Clerk can also provide a certificate of Notary Public of a notary that was sworn into office in Middlesex County. The fee is $5 per certificate.
Applications and Renewals
To become a Notary Public, you must fill out the Notary Public application. Applications are available online on the State of New Jersey website by clicking here. There is a fee of $30 to apply for or renew your notary online.
Prospective notaries must have their applications signed by a legislator. When filing your application online, it will be sent to your legislator electronically.
Pursuant to P.L. 2021, c. 179, New Jersey implemented an updated notary public program. The new law institutes a number of important changes that collectively help to modernize the notary commissioning process and general notarial practices in this state.
We strongly encourage all current and prospective New Jersey notaries public, as well other interested parties, to read the law, the supporting administrative rules and revised New Jersey Notary Public Manual to gain an understanding of the new provisions.
Swearing In
You should receive your Notary Commission forms in the mail within approximately two weeks from the date the application is submitted.
Once you receive the Notary Commission Certificate, you have 90 days from the date of issuance to appear in person at the Middlesex County Clerk’s Office to be sworn in as a Notary Public. You must bring your Notary Certificate and driver’s license/proof of address. There is a $15 fee for swearing in which can be paid via cash, check, or credit.
